Following up on Mark's comments on the increased primary enforcement of VT's helmet laws, I stopped in at the Brattleboro state police barracks today to get the official scoop. The trooper there refered me to VT Code Subsection 1256 which simply states that a DOT approved helmet must be worn while operating a motorcycle in VT. He also refered me to Lt John Flannigan as the top authority on what is or is not required.
Lt. Flannigan's response is quoted below:
"23 VSA 1256 specifically refers that the helmet is compliant with 49 CFR 571.218, essentially a "DOT approved helmet". While reflective material is a good idea, it was removed from statute effective July 1, 2009 and is no longer required.
Just because a helmet has a DOT sticker, does not necessarily mean it is compliant. Some non-compliant (novelty) helmets have had DOT stickers placed on them.
Compliant helmets are generally recognizable by many of the following factors;
1. Thick inner liner (1- 1 ½ ")
2. Sturdy chin strap and rivets
3. Weight of helmet
4. Design/Style of helmet
5. DOT sticker
6. Snell or ANSI labeling
7. Manufacturer's labeling
Vermont takes great pride as a one of the safest states in the country. Motorcycle riders are welcomed in our state and we expect they also have the right safety equipment and comply with our motor vehicle laws.
